Vehentis Limited General Terms and conditions

Vehentis Limited values its good reputation as a high-quality web hosting provider. Hence, it is very important to us that our customers use our services and the Internet as a whole in a responsibly and courteously fashion.

The vast majority of our customers do so and breach these Terms and Conditions or Acceptable Use Policies (AUP) is rare. Nonetheless some customers will always ignore the rules, for this reason we outline below what we consider unacceptable uses of our service. Breaching any of these can result in the suspension or termination of your the account and all other accounts that you may hold with Vehentis Limited.

General

We expect all of our customers to behave in a polite and courteous manor towards fellow users of the Internet and our services.

As such our clients are required to adhere to these Conditions of Use. You are also required to adhere to any additional Acceptable Use Policies ("AUPs") that we may publish from time to time. If you breach them, we have the right at our sole discretion to suspend or terminate your account without notice or to block access to the relevant component of the service.

Refund Policy

You have the right to cancel any service provided to you by Vehentis Ltd, by giving written notice to support@vehentis.co.uk or to the address listed on the contact page.

Services canceled within 7 days of purchase will be refunded in full. Thereafter, a 7 days notice period is required after which a refund will be offered for any full months of service remaining.

Refunds will only be offered for Domain Name Registrations and SSL Certificates in the case of an error by Vehentis Ltd in the acquisition of these items. As by definition a Domain name registration is made to order.

Email

Spam

We take spam mail very seriously, we will instantly suspend an account if we are led to believe the owner is involved in unsolicited bulk mailing regardless of whether they are using our system to carry out their activities or not.

Mailing Lists

We also take very seriously the act of subscribing someone to an electronic mailing list without their prior consent. If you are running a mailing list it is your responsibility to make sure that users whose email addresses are entered actually want to be subscribed to your mailing list, if we receive complaints that you are not doing this we may at our discretion terminate your account.

Mail-bombing

Any user that is found to be participating in the act of mail-bombing (inundating a user with email without a serious intent to correspond with them) shall have their account terminated. Any user who is repeatedly the subject of such attacks (or attracts such attention) will be asked to leave our systems.

Unlawful Use

General

Unlawful uses of our services includes (but is not limited to): drug dealing; pirating; hacking; cracking; copyright infringement; gambling; distribution of obscene materials; fraudulent activity; sending a message or having content that is obscene, lewd, lascivious, filthy, or indecent with intent to annoy, abuse, threaten, or harass another person; threatening bodily harm or damage to individuals or groups; Vehentis Limited reserves the right to check system files, email, and other data on our servers for illegal content and materials, or for any other reasons deemed necessary.

MP3s

MP3s are acceptable on our servers as long as you personally own the copyright to the material stored therein e.g. You have recorded your band playing your latest track. We will not tolerate the storage, distribution, promotion or linking to of illegal MP3s as these MP3 files constitute a breach of international copyright agreements, such violations shall be taken very seriously and reported to the appropriate authorities. We reserve the right to inspect all MP3 files (or files suspected of being MP3s e.g. Zip files containing them, files with altered extensions).

Pornography

Pornography and sex-related merchandising, or links to such material, even if legal, is not an acceptable use of Vehentis Limited servers.

Abuse of Server Resources

• Abuses of our server resources includes (but are not limited to): Running background tasks without prior written permission
• Running chat rooms
• Internet Relay Chat IRC Bots; daemons and other executable files
• Receiving more than 1000 emails a day
• Further more any usage of 10% or greater resource usage (CPU, Memory etc.) is an undue burden to our system and is not acceptable - If you do not comply with this ruling then your account may be terminated immediately without notification (You will have the right to appeal to us and no other body).

Hacking/Cracking

Vehentis Limited reserves the right to report illegal activities to any and all regulatory, administrative, and/or governmental authorities for prosecution.

The following examples of unacceptable behaviour are non-exclusive, and are provided for guidance purposes. If you are unsure if your actions will be a violation of our policies please ask abuse@vehentis.co.uk

Server broadcast messages or any message sent on an intrusive basis to any directly or indirectly attached network. Attempt to circumvent any user authentication or security of host, network, or account. Accessing data not intended for user. Probing the security of any network. Spawning dozens of processes; Port scans,ping floods,packet spoofing,forging router information,Denial of Service attacks, sniffers, flooding, spoofing, ping bombing, smurfs, winnuke, land, teardrop. Promulgation of viruses. IRC bots such as eggdrop or BitchX.

Any activity, whether or not the intrusion results in the corruption or loss of data, will be investigated and proper action taken. The presence of any of these programs, whether or not run, will result in action against the user including suspension or termination of accounts held by the user.

Client Responsibility

The client is responsible for all activity originating from the account unless proven to be a victim of outside hacking or address forgery. The client assumes responsibility for all material on their site, and material that may be put on by a third party (such as the usage of Free For All links pages).

You will keep your passwords and security phrase secret and will not disclose them to third parties for ANY purpose. You will notify us and change any password which you believe may have been compromised.

Use of Vehentis Limited service requires a certain level of knowledge in the use of Internet languages, protocols, and software. This level of knowledge varies depending on the anticipated use and desired content of the web space by the client. The following examples are offered:

• Web Publishing: requires knowledge of HTML, properly locating and linking documents, FTPing Web contents, Graphics, text, sound, image mapping, etc.
• CGI-Scripts: requires knowledge of the UNIX environment, TAR & GUNZIP commands, Perl, CShell scripts, permissions, etc.
• Mail: a use of mail clients to receive and send mail, etc.

The client agrees that he or she has the necessary knowledge to create and maintain their web space. Client agrees that it is not the responsibility of Vehentis Limited to provide this knowledge or support outside matters specific to Vehentis Limited servers.

You will not sell on or share use of the service, or any part of it, with any other person/company except with express permission of Vehentis Limited

You agree to pay promptly all invoices issued by Vehentis Limited, if invoices are not paid by their due date Vehentis Limited may at it's discretion suspend access to your account.

If the invoice remains outstanding then Vehentis Limited at it's discretion may take advantage of the legal protection given to it by the The Late Payment of Commercial Debts Act 1998. Vehentis Limited may also use a debt recover agency which could lead to a record being made in your credit history about the late or non-payment of the invoice.

You agree to pay for an additional bandwidth usage over your pre-allocated amount at the current rate, which is currently £1.50 per additional 100MB or part thereof. This rate may change.

Backups

Data stored on our servers is not guaranteed to be backed up. Although we do backups of our server it is the customers responsibility to ensure that they have backups of important data, as Vehentis Limited accepts no responsibility for loss of data.

IP Numbers/Addresses

Vehentis Limited maintains control and any ownership of any and all I.P. numbers and addresses that may be assigned to the client and reserves in its sole discretion the right to change or remove any and all IP numbers and addresses.

Limitation of Liability

Vehentis Limited shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Vehentis Limited servers going off-line or being unavailable for any reason whatsoever. Further, Vehentis Limited shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site or other data from one of Vehentis Limited servers. All damages shall be limited to the immediate termination of service. Vehentis Limited shall be the sole arbiter of what is and is not a violation of these acceptable use policies. Vehentis Limited reserves the right to terminate an account at any time and for any reason that causes harm to any of Vehentis Limited customer web sites. Vehentis Limited reserves the right to delete all content and files upon termination. Vehentis Limited reserves the right to withhold any pre-paid funds for any site removed for violations of these policies. Vehentis Limited reserves the right to refuse, cancel, or suspend service at our sole discretion.

Vehentis Limited reserves the right to change the Acceptable Use Policy without prior notice or warning. Non-enforcement of any part of the Acceptable Use Policy does not constitute consent.
